HUMBLE – Jose Damian, 17, was killed after being struck by a drunk driver on Sunday, November 8.
The Damian family was on their way to a truck show when their vehicle got a flat tire. They pulled into the shoulder and replaced the flat; Jose – who had just celebrated his 17th birthday two days prior – was putting the car jack in the bed of the truck when he was struck by a sedan.
Charles Baxter Jr., 32, was driving drunk when he slammed into Jose Damian on the Eastex Freeway at FM 1960. After searching Baxter’s vehicle, authorities also found Xanax pills in Baxter’s possession that weren’t prescribed to him.
Baxter was taken to Lyndon B. Johnson Hospital with minor injuries to his neck. He was treated and released to police, who booked him into the Harris County Jail. Baxter is being charged with intoxication manslaughter and possession of a controlled substance; he’s being held on a $32,000.
